Debt Collectors Lying About How Much Money Consumers Owe
One of my first debt collection harassment clients had less than $300 charged off from her credit card. The debt was sold at least twice to one debt collector, then the next. Three years later, she was sued for more than $1,000.00. The debt collectors continued to charge her interest long after the credit card company had stopped.
Debt collectors continuing to charge interest on credit card debts they purchase is illegal under the Fair Debt Collection Practices Act.
Most courts will hold debt collectors “strictly liable” under the Fair Debt Collection Practices Act and the Arkansas Fair Debt Collection Practices Act for lying about the money you owe on a credit card debt. “Oops, we really didn’t lie about the amount. We made a mistake,” does not fly in court.
